Dear ART Rider:

  • The City of Asheville, and its contractors who operate ART, (collectively referred to as “ART”) are pleased to provide this free, open access to the internet via a cellular wireless network connection (referred to as the “Service”) for ART riders who agree to and accept these terms of use.
  • The Service is accessible by the general public and is not secure or private. Do not use the Service to communicate or transmit any sensitive or private information or data such as credit card information or passwords.
  • The Service may be unreliable and inconsistent, and ART may turn off or block the Service at any time and for any reason.
  • ART will not be responsible or liable to you for any damages resulting from your use, or the use by others, of the Service. You agree to indemnify ART for any claim made against ART or for damages or injuries incurred by ART, its employees, officers, officials, or agents, resulting from your use of the Service.
  • You are prohibited from using the Service for any unlawful, illicit, or harmful purpose such as inducement of incitement, obscenity, pornography, false advertising, or copyright infringement.
  • Your use of the Service and communications may be monitored and recorded by ART and disclosed to others at the sole discretion of ART. ART reserves the right to block access to any rider who uses the Service for any unlawful, illicit, or harmful purpose.
